One of the most frequent questions that is asked all the time is about this one little cover. What is Efficacy Liability? It is a question that has produced many answers and sometimes even more questions.
We will attempt to address these in this article.
What is Efficacy Liability?
The easiest explanation is that efficacy liability, in the case of Fire, Sprinkler and Suppression Installers, protects you should the device that you have either installed, or maintained, fails to perform in its intended purpose.
Examples of this could be that a sprinkler head goes off when it shouldn’t, or even worse, doesn’t go off when it should. If this scenario can be traced back to you, you could be held responsible for all resulting damage and delays caused.
Do I require this cover?
The answer is almost always yes, once you understand the ramifications of efficacy based claims, this cover becomes clear. A good statistic to understand is approximately 80% of all claims that occur in the Sprinkler and Suppression field are efficacy. This means that if a claim occurs, it will usually be attributed to this cover. These claims, however, are not generally small, with most claims starting in the high five figures and usually extending into six and sometimes even seven figure claims!
Is Efficacy Cover Expensive?
For Sprinkler and Suppression Installers – Yes
This cover could increase your premium by as much as eight to ten fold and also you need to have the right experience, usually requiring a minimum 3 years Sprinkler and Suppression Experience before a company will be willing to offer you this cover.
The reason for this – The amount paid in respect of all efficacy claims that insurance companies have already paid out.
To give some history, about seven years ago, there was about eight or nine different insurance providers that would offer efficacy cover for Sprinklers and Suppression Installers, and over the years this number has decreased.
Nowadays, there are only a handful of companies that will be willing to offer Efficacy Liability and is due to the claims payments exceeding the premium income.
One of the main gripes is the Installers and Maintainers who have had no claims have seen their premiums increase, and this is due to level of claims, as an industry, that have been paid out against the amount of premium being paid in. Insurance is still a business and it has to make profit.
Here are a few Misconceptions:
If a device fails to perform, it is covered under my products liability.
FALSE – Products Liability will cover for:
1. Injury to a Third Party
2. Damage to a Third Party’s Property and Goods
However, only if the cause is by a faulty device that you have sold or given away. Products Liability does not offer cover for any device that you have not installed properly, or through poor workmanship, nor does it cover for the financial impacts that may arise to that business or individual.
My Professional Indemnity Insurance will cover for my Efficacy.
FALSE – Professional Indemnity will protect you for any designs that you may have made an error on or any bad advice you may give. If will not cover you for damages caused by faulty installation or Maintenance of a product.
The device went off because of a manufactures default so I cannot be held Liable by the Third Party.
FALSE – You have been contracted to do the job and the device you installed had not worked correctly, therefore contactors will pursue you for the loss and damage that you have caused. It is up to you (or your Insurance Company) to contact the Manufacturer and you (or your Insurance Company) must get the manufacturer to admit Liability, your insurer will then pass on any costs incurred to the manufacturer.
I have a signed declaration from the client that states once the job is complete, I cannot be held Liable for any damages occurred.
FALSE – A signed declaration is a great deterrent and most insurers insist upon it, however, should the contractor take you to court, in the eyes of the law, if you can be attributed to the loss or damage, you will be held responsible.
My Contractor has agreed that they will take full responsibility for any failings once my job is completed and signed off.
GREAT – Get it in writing!
